The Conviction or Conspiracy documentary returns to one of the strangest corporate collapses of the last decade and asks whether the public ever got the whole story. Directed by British filmmaker Mark Soldinger, the film follows the rise, the fall and the extraordinary legal battle of Trevor Milton, the founder of the hydrogen trucking company Nikola. What makes it unusual is its refusal to hand the viewer a tidy verdict. It lays out the case that sent Milton to a federal courtroom, then lays out the case his defenders make, and leaves the weighing to you.

The Pitch That Briefly Beat Ford

Nikola was built on a promise that sounded enormous and, to many investors, entirely plausible. Long haul trucking is one of the hardest sectors to decarbonize, and Milton argued that hydrogen fuel cells paired with battery electric powertrains could do it. He was a relentless salesman, fluent in the language of disruption, and he found a market that wanted to believe. The company went public through a reverse merger in 2020, and for a brief and now famous moment its market capitalization climbed above that of Ford, a company that had been building vehicles for more than a century.

The film spends real time on this period because it explains everything that follows. A company with no vehicle in commercial production was being valued as though the future had already arrived. That gap between the story being told and the product being built is the fault line the rest of the saga runs along.

What the Conviction or Conspiracy Documentary Covers

The documentary traces the full arc, from early pitch decks and prototype reveals through the short seller report that detonated the company’s reputation, the resignation, the indictment, the trial and the aftermath. It draws on interviews and archival footage of Milton’s own promotional appearances, which turn out to be the most important evidence in the story, since much of the legal fight concerned what he said in public rather than what the company did internally.

Crucially, the film does not treat the trial as the end of the narrative. It carries the story forward into the debate about whether the prosecution was proportionate, and it gives significant screen time to people who believe it was not. That structure is what earns the title. The viewer is asked to decide which word applies.

The Case That Led to a Conviction

In September 2020 the short selling research firm Hindenburg Research published a report accusing Nikola of misleading investors about the state of its technology. The single most damaging item was a promotional video of the Nikola One truck that appeared to show the vehicle driving. The truck, the report alleged, had been towed to the top of an incline and filmed rolling down under gravity. Milton resigned as executive chairman later that month.

Federal prosecutors in Manhattan charged him with defrauding retail investors by making false statements about the company’s products and capabilities. In October 2022 a jury convicted him on one count of securities fraud and two counts of wire fraud, and acquitted him on a further count. He was sentenced to a four year prison term in December 2023. The prosecution’s position was straightforward. These were not the ordinary exaggerations of an ambitious founder, they were material misrepresentations that moved a stock price and cost ordinary people money.

The Counterargument the Film Gives Air To

The other half of the Conviction or Conspiracy documentary belongs to Milton’s defenders, and their argument is worth understanding even if you do not accept it. They contend that forward looking optimism is the normal currency of the startup world, that nearly every founder describes a product as it is intended to be rather than as it currently is, and that Milton was singled out for behavior that is tolerated across the sector. They point out that he was the only executive charged. They argue that the short seller who triggered the collapse stood to profit from it, and that this conflict of interest received far less scrutiny than Milton’s statements did.

Milton received a presidential pardon in 2025, and the film treats that as another turn in the story rather than as a settled vindication. It is worth being clear about what a pardon does and does not do. It removes the legal consequence, it does not overturn the jury’s finding of fact. Mainstream legal commentary has generally held that the conviction rested on specific provable false statements, not on ordinary startup optimism, and viewers should weigh that against the film’s more sympathetic voices.

Why It Is Worth Watching

This is a useful film precisely because it sits in uncomfortable territory. Anyone certain that Milton was simply a fraud will find the final third harder going than expected. Anyone certain he was purely a political scapegoat will have to sit with the footage of the rolling truck. The documentary is at its strongest when it stops arguing and simply shows you the primary material, letting Milton’s own recorded claims stand next to the engineering reality of the time.

The larger questions it raises outlast the particular case. Where is the line between vision and deception in a culture that rewards founders for describing products that do not yet exist? Who decides when that line has been crossed, and why do some people get prosecuted for crossing it while others are celebrated? Those questions apply well beyond one trucking company.
